VIRGINIA'S ABORTION AMENDMENT: WHAT THE LANGUAGE ACTUALLY SAYS
Before voting on any constitutional amendment, Virginians should read what it does. Constitutional amendments have long-term consequences and are extraordinarily difficult to change once adopted.
1.THE AMENDMENT CREATES A NEW FUNDAMENTAL CONSTITUTIONAL RIGHT.
Amendment Language:
"Every individual has the fundamental right to reproductive freedom..."
Why It Matters:
This is not an ordinary statute. The amendment elevates reproductive freedom—including abortion—to one of the highest levels of constitutional protection under Virginia law. Future legislators will be limited in their ability to enact abortion restrictions or protections because courts will treat abortion as a fundamental constitutional right.
 
2.THE AMENDMENT PROTECTS ABORTION CARE AS A CONSTITUTIONAL RIGHT.
Amendment Language:
"...including the ability to make and carry out decisions relating to one's own prenatal care, childbirth, postpartum care, contraception, abortion care, miscarriage management, and fertility care."
Why It Matters:
The amendment specifically constitutionalizes abortion care. This language goes far beyond merely preserving current law. Courts interpret constitutional rights broadly, and they become enforceable against future legislative action. Any future pro-life legislation would be interpreted by this Constitutional Amendment.
 
3.THE AMENDMENT PROHIBITS DIRECT OR INDIRECT BURDENS ON THIS RIGHT.
Amendment Language:
"An individual's right to reproductive freedom shall not be, directly or indirectly, denied, burdened, or infringed upon..."
Why It Matters:
The phrase "directly or indirectly" is extremely broad. Courts could be asked to determine whether parental involvement laws, waiting periods, informed consent requirements, or other commonsense regulations indirectly burden the exercise of this constitutional right.
 
4.THE AMENDMENT MAY PLACE PARENTAL RIGHTS IN JEOPARDY.
Amendment Language:
"Every individual has the fundamental right to reproductive freedom..."
Why It Matters:
The amendment does not distinguish between adults and minors. It uses the term "every individual." It contains no language protecting parental consent or parental notification laws. Those protections would be left to future litigation and judicial interpretation. The key fact is, a 15-year-old girl can be taken by a guidance counselor at her High School to Planned Parenthood to have an abortion and does not have to notify her parents…. PROTECTED!!! A sex trafficker can force his victims to an abortion clinic to cover up his crime… PROTECTED!!! Parents are taken out of the equation, and criminals are given more protection than parents or the victims.
Parents should ask themselves one simple question: If parental rights were meant to be protected, why are they not mentioned in the amendment?
 
5.THE AMENDMENT ALLOWS THIRD-TRIMESTER ABORTIONS UNDER BROAD EXCEPTIONS.
Amendment Language:
"The Commonwealth may regulate the provision of abortion care in the third trimester..."
However:
"...in no circumstance shall the Commonwealth prohibit an abortion ... medically indicated to protect the life or physical or mental health of the pregnant individual..."
Why It Matters:
The amendment permits abortions in the third trimester whenever, in a physician's professional judgment, the mother's physical or mental health is at risk, or the fetus is deemed nonviable. The amendment places that determination in the physician's professional judgment.
 
6.THE AMENDMENT PROHIBITS PUNISHING THOSE WHO AID OR ASSIST ABORTIONS.
Amendment Language:
"The Commonwealth shall not penalize, prosecute, or otherwise take adverse action against any individual for aiding or assisting another individual in exercising such other individual's right to reproductive freedom..."
Why It Matters:
This provision provides constitutional protection not only for the person obtaining the abortion but also for individuals who assist in exercising that right, with voluntary consent.
 
7.THE AMENDMENT NARROWS WHAT QUALIFIES AS A COMPELLING STATE INTEREST.
Amendment Language:
"For the purposes of this section, a state interest is compelling only if it is for the limited purpose of maintaining or improving the health of an individual seeking care..."
Why It Matters:
Traditionally, courts determine whether a state has a compelling governmental interest. This amendment narrows, under the Constitution, what Virginia may claim as a compelling interest. Future legislatures could face significant constitutional obstacles when attempting to enact pro-life protections. In this case, the compelling state interest would be based on the desires of the woman seeking the abortion; therefore, any future pro-life legislation would be based on this.
 
8.THE AMENDMENT IS SELF-EXECUTING.
Amendment Language:
"This section shall be self-executing."
Why It Matters:
This means the amendment becomes enforceable immediately upon adoption, without requiring implementing legislation. Individuals may rely on the constitutional language itself to challenge Virginia laws and regulations. When constitutional provisions are self-executing, judges, not legislators, become the primary interpreters of the language. Judges will decide on parental rights, the health of the mother, and whether a state can refuse to fund abortion with taxpayer dollars. Lawyers could immediately argue in Court that anything conflicts with the language of the Amendment. Self-executing language is designed to prohibit legislators from implementing this constitutional right.
BOTTOM LINE
This amendment is not simply about preserving current abortion law. It creates a new constitutional right, limits the Commonwealth's authority to regulate abortion, potentially threatens protections for parental rights, broadens legal protections for abortion-related decisions, and places significant authority in the judiciary to determine its scope for generations to come.
Constitutional amendments should never be voted upon based upon slogans or campaign advertisements. Virginians should carefully read the actual language and understand its legal consequences before casting their vote.
